If I sell to you a genuine McLaren spoiler for $300 and you find out later that
it was not a
McLaren spoiler at all that you purchased, but in fact a standard issue $129
Mustang spoiler..
would you not try to either return the goods and get a refund or would you
silently accept the
fact that you paid a higher then market price because you were lead to believe
the item was a rare
and limited McLaren spoiler. No one likes to be made a sucker.

Misrepresentation of merchandise is unfortunately an all too common occurence
in our society, that
attempts to take advantage of the uninformed. The laws are there to protect
the consumer when a
swindle takes place.

With eBay the purchaser is usually purchasing the vehicle at a distance from
the car itself. They
take the information provided in the auction description as being something
that they can base
their opinion on whether to bid or not to bid on a vehicle. They do not have
the opportunity to
visit the vehicle or in that case examine the vehicle's registration papers.

Similarly, not all people out there are 'hip' to the fact that there are
'Capri' models and
'Mustang' models. We can just chalk them up to the ill-informed part of
society.

The misrepresentation of a vehicle, as being a Ford Mustang as compared to a
Mercury Capri,
without any further clarification in the ad rectifying the 'similarity' of the
vehicle, hopes to
deceive the uninformed who are not necessarily aware that there were 'Capri'
models as compared to
'Mustang' models.

So yes, it is very possible that a purchaser of that vehicle may be falsely
mislead into believing
he has purchased a 'Mustang'. And although he may be very thrilled to learn
that his purchase
turns out to in fact be a 'Capri' it is not what he negotiated or purchased.

So the bottom line to this tale is not to advocate litigation, but to wonder
why some of these
advertisers clearly persist in falsely representing the vehicles as Mustangs
when they are Capris.
